1. Agreement to Terms

By accessing or using any service provided by Hosting HD Premium ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These Terms apply to all visitors, customers, and others who access our website or use our hosting services.

2. Description of Services

Hosting HD Premium provides web hosting services including, but not limited to, Virtual Private Servers (VPS), managed WordPress hosting, web hosting, dedicated servers, and related services. Services are provided on a subscription basis and billed according to the plan you select at the time of purchase.

3. Account Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account at security@hostinghdpremium.com.

4. Acceptable Use Policy

You agree not to use our services for any of the following prohibited activities:

• Hosting or distributing illegal content of any kind
• Sending unsolicited bulk email (spam) or operating spam-related services
• Running cryptocurrency mining operations without prior written approval
• Conducting network attacks, port scanning, or denial-of-service attacks
• Hosting phishing sites, malware, or other malicious content
• Infringing any third-party intellectual property rights
• Violating any applicable local, national, or international law or regulation
• Reselling our services without prior written agreement
• Using our infrastructure to gain unauthorised access to third-party systems

We reserve the right to suspend or terminate accounts found in violation of this policy, without notice, at our sole discretion.

5. Payment and Billing

All fees are billed in advance on a monthly or annual basis, depending on your selected plan. You authorise us to charge your payment method on a recurring basis. All fees are non-refundable except as explicitly stated in our refund policy. We reserve the right to modify pricing with 30 days' notice.

30-Day Money-Back Guarantee: New customers are entitled to a full refund within 30 days of their first purchase if they are not satisfied, no questions asked. This applies to first-time purchases only.

6. Service Level Agreement (SLA)

We commit to a 99.9% monthly uptime guarantee for all VPS and hosting services. In the event that uptime falls below this threshold in any given calendar month, affected customers will be eligible for a service credit. Credits are calculated as a percentage of the monthly fee proportional to the downtime experienced and must be requested within 30 days of the incident.

7. Data and Backups

While we provide automated backup services on eligible plans, you are solely responsible for maintaining your own independent backups of all data hosted on our servers. We are not liable for data loss. We strongly recommend maintaining at least one off-site backup of all critical data at all times.

8. Intellectual Property

All content on the Hosting HD Premium website, including text, graphics, logos, and software, is the property of Hosting HD Premium or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Hosting HD Premium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services. Our total liability to you for any claim arising from these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Hosting HD Premium, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your violation of these Terms, your use of our services, or your violation of any third-party rights.

11. Termination

You may cancel your account at any time by contacting us. We may terminate or suspend your account immediately, without notice, if you breach these Terms. Upon termination, your right to use the services ceases immediately. We may retain certain data as required by law.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
